Terms of the contract
Apart Hotel San Martin: Lodging service provider. CLIENT: Passenger who takes the services of Apart Hotel San Martin (of legal age). CHECK-IN: Check-in process of the client at the hotel before entering the room. CHECK-OUT: Check-out process of the client at the moment of finishing the use of the hotel services. NO-SHOW: It is the non-presentation of the passenger at the hotel before 23:59 hours of the scheduled day of arrival, without prior communication from the client. RESERVATION: Agreement between Apart Hotel San Martin and the Client to reserve the room(s) for the dates requested by the client in any hotel of the Apart Hotel San Martin chain. SERVICE CHARGE: 10% surcharge for services rendered by Apart Hotel San Martin. GENERAL SALES TAX (IGV): Tax corresponding to 18% of the rate.
General terms and conditions
By making a reservation through Apart Hotel San Martin Web, the Client declares that he/she has been informed and/or has had access to the contents of the “Frequently Asked Questions” section of our web site www.sanmartinhotel.com. which are part of the terms of this contract. Likewise, you unconditionally accept the following terms and conditions. No agent, servant, representative, or third party has the power or capacity to modify, restrict or extend the terms of this contract.
Conditions for booking via www.sanmartinhotel.com. .
- The rates shown in the first step of the purchase process are net, do not include the IGV charge or service charge. In the last step of the purchase process only the service charge corresponding to 10% is added in all Apart Hotel San Martin hotels.
- Rates are per night/room, not per passenger. The cost of additional beds in the room depends on the availability of the hotel and the type of room. According to hotel availability, an extra bed, rollaway or sofa bed will be provided, and maximum use for children up to 12 years old. For more information, please contact info@hotelapart.com.
Cancellation policies:
- Cancellation 1 day: Reservations can be modified or cancelled up to 1 day before check-in (Peruvian time) without additional charges.
- Cancellation and No-Show Policy: Guests are advised that a charge equivalent to one full night’s stay will be applied in the event of reservation cancellation or failure to arrive at the scheduled check-in time.
- Cancellation 7 days: Reservations can be modified or cancelled up to 7 days prior to check-in (Peruvian time) without additional charges.
- Non-Refundable: Prepaid reservations, no modifications, cancellations, transfers or refunds are accepted.
- The No-Show penalty corresponds to the total amount of the stay.
- All rates will be charged in US dollars (USD). And the proof of purchase will be issued in USD.
- The confirmation of the reservation will be made within 24 working hours after the reservation is made.
- In the case of prepaid reservations, the total amount of the stay will be charged to the credit card within 48 business hours after the reservation is made. For reservations made the day before or on the day of check-in, the credit card will be charged for the entire stay at check-in.
- In the case of reservations with a “pay at the hotel” condition, Apart Hotel San Martin’s website does not accept debit cards. In case of entering a debit card, the reservation will be cancelled without prior notice.
- In the case of “prepaid” reservations made through the Apart Hotel San Martin website, the charge will be made immediately to the credit or debit card on file.
- In case the credit card shows the messages: “denied”, “stolen”, “insufficient funds”, “expired date”, the reservation will be cancelled without prior notice.
- We reserve the right to cancel or modify reservations in those cases where it is considered that the customer has engaged in fraudulent or inappropriate activity.
- In case of error and/or duplicity in the reservation made by the client, Apart Hotel San Martin assumes no responsibility for this fact and will apply the penalty according to the policy of the reservation.
- In case of group reservations of more than 5 rooms Apart Hotel San Martin reserves the right to apply special policies and deadlines.
Conditions for the Check-in and Check-out process
- No food is allowed in the hotels, except for medical restrictions.
- It is required to present Identity Card (DNI) or passport, foreigner’s card of all the occupants of the room (including children) and visitors. In case the guest wishes to bring guests to his room, it is essential that they are duly identified and registered by means of the identity document. Apart Hotel San Martin will allow minors to enter the hotel only when they are accompanied by their parents, guardians, curators, responsible and with express authorization from them to enter the hotels (Notarized permission).
- The maximum number of visitors allowed per room is 02 people.
- Persons domiciled in Peru will be subject to the payment of 18% of the General Sales Tax (IGV) at the hotel reception desk (applies to reservations made on the Apart Hotel San Martin website).
- For the exoneration of the General Sales Tax (IGV) it is indispensable to present a valid passport and the Andean Migration Card (TAM) with an entry term not exceeding 60 days.
- Peruvian guests who do not reside in Peru must prove their residence in the foreign country with the corresponding documentation.
- Check-in and Check-out times vary according to the hotel where the reservation was made, and will be detailed in the reservation confirmation.
- Any request for Early Check-in and/or Late Check-out is subject to an additional charge and must be requested by e-mail: info@hotelapart.com or directly at the hotel’s front desk (subject to availability).
- A CREDIT CARD must be presented at check-in to guarantee lodging and extras during your stay. This CREDIT CARD will be pre-authorized.
- At Apart Hotel San Martin we admit guests accompanied by their dog (Pet) as long as they comply with the present Admission Policies. Only two dogs are allowed per room at a rate of $63.00 per dog (including taxes and services) per night. At the time of reservation, the guest must present the certificates issued by the licensed veterinarian (or competent governmental body) that certify the updated vaccinations and deworming of your pet, with an antiquity not older than 1 year. It is necessary to carry the above mentioned certificates during your stay at the hotel and to present them in case of request from Apart Hotel San Martin staff. - In the case of guide dogs, a CONADIS certificate must be presented, certifying that the dog’s company is necessary (visual or emotional disability, glucose measurement or other type). If the CONADIS certificate is not available, the guest will be charged per night of the pet’s stay. It must be coordinated with the hotel at least one week prior to arrival.
Conditions for hotel stay
- We offer airport-hotel-airport transfer in private service for an additional charge.
- According to the availability of each hotel and room type, up to two (02) children (under 12 years of age) are allowed to share a room with two adults at no extra charge.
- The buffet breakfast included per room is considered for two people, between adults or children. If children are staying in the room, the buffet breakfast will be charged according to the age of the children.
- Additional breakfasts will be charged as follows:
- Apart Hotel San Martin Standard: Maximum 01 child allowed in the room 0 to 7 years old: Maximum 01 child allowed, will be free of room and breakfast, sharing bed with parents.
- 8 to 12 years old: A maximum of 01 child will be allowed, free of room charge, sharing bed with parents. Breakfast must be paid for.
- Apart Hotel San Martin: Maximum 02 children allowed in the room.
- 0 to 7 years old: The 1st child will be allowed free of room and breakfast. The 2nd child will pay breakfast. The child(ren) share bed with parents.
- 8 to 12 years old: A maximum of 02 children will be allowed free of charge only, sharing bed with parents. Breakfast must be paid for.
- It is only possible to place extra beds, rollaways or sofa beds in some of our rooms in certain hotels. Previous coordination is required and will imply an additional charge.
- It is not possible to put the beds of the rooms together.
- We have free cribs and/or “pack & play” sets in all units (subject to availability), please ask at check-in.
- The rooms and common areas, in some units, have facilities and access conditions for people with special needs.
- If you wish to extend your stay, please inform the front desk at least 24 hours prior to your departure date. The extension will depend on room availability.
- In the event that Apart Hotel San Martin is not able to provide the client’s accommodation, due to force majeure or unforeseen circumstances, it undertakes to provide a solution by offering accommodation in any of its nearest hotels, or in other nearby hotels of similar or higher category.
- In accordance with the General Law for the Prevention and Control of the Risks of Tobacco Consumption, Law Number 29517, smoking is prohibited in the rooms. In the event that a guest fails to comply with the provisions of this paragraph, a penalty of USD 250 per day shall be applied to said guest.
- The hotel offers free WiFi in public areas and rooms; and High Speed WiFi at an additional cost.
- Not all of our hotels have on-site parking facilities, so we do not guarantee parking spaces for any passenger (subject to availability on a first-come, first-served basis). If parking availability is confirmed at the hotel, it is free of charge.
- The hotel is not responsible for the loss or loss of money, jewelry and/or other valuables left in the room. We kindly ask our guests to leave the doors of their rooms properly closed, as well as to use the safety deposit boxes located in their rooms or declare them and leave them in custody at the hotel’s front desk. The availability of a safe deposit box at the front desk may vary from hotel to hotel.
- All personal items forgotten by our guests and found by a hotel employee will be stored according to the storage protocol by category.
- In order to provide a comfortable stay for all our guests, we require quiet hours between 11 p.m. and 9 a.m.
- It is forbidden the entrance to the rooms of any person not registered in the hotel.
- If you wish to consume alcoholic beverages purchased outside the hotel, a corkage fee communicated by the hotel will be applied.
- We do not offer tours, but we can put you in touch with a local operator.
- Apart Hotel San Martin is against the trafficking of archaeological pieces belonging to the Peruvian Cultural Heritage.
- Apart Hotel San Martin is against the trafficking of protected species.
- The possession and consumption of hallucinogenic drugs within the hotel facilities is prohibited.
- Sexual exploitation and abuse of minors is punishable under criminal and civil law.
- The hotel offers access to smart TVs that allow guests to log in to their personal entertainment platforms (such as Netflix, YouTube, among others), subject to availability. The availability of this service may vary from hotel to hotel, so the guest should consult in advance at the time of booking.
- It is the sole responsibility of the user/guest to ensure that he/she logs out before concluding his/her stay. The hotel is not responsible for unauthorized access or misuse of personal accounts if the guest has not properly logged out. By signing this document, the guest releases the hotel from any liability for claims related to the use or misuse of such accounts on in-room devices.
- The hotel reserves the right to limit the sale of alcoholic beverages to any person who presents an evident state of drunkenness, characterized by signs such as difficulty in maintaining balance, altered speech or difficulty in expressing oneself clearly, aggressive or disinhibited behavior, among others, without limiting itself exclusively to these. The purpose of this measure is to ensure the safety and well-being of guests and staff.
Terms and Conditions for reservations at Hoteles Asociados
ASSOCIATE HOTELS: Group of hotels that have the quality of Associates of Apart Hotel San Martin and that use to distinguish themselves the brand “Hoteles Asociados Apart Hotel San Martin” Apart Hotel San Martin: Sales and Reservations Manager. CLIENT: Passenger who takes the services of the Associated Hotels (of legal age). CHECK-IN: Check-in process of the client at the hotel before entering the room. CHECK-OUT: Client’s check-out process at the moment he/she finishes using the hotel services. NO-SHOW: It is the non-presentation of the passenger at the hotel before 23:59 hours of the scheduled day of arrival, without prior communication from the client. RESERVATION: Agreement between the Partner Hotel and the Client to reserve the room(s) for the dates requested by the client. SERVICE CHARGE: 10% surcharge for services rendered by Apart Hotel San Martin, if applicable. GENERAL SALES TAX (IGV): Tax corresponding to 18% of the rate, if applicable.

The terms and conditions apply to all the Associated Hotels that belong to the Apart Hotel San Martin Associates Network.
- Customer Service Policy: Apart Hotel San Martin is not part of the contractual relationship between the Partner Hotel and the Client, any claim or complaint about the lodging service must be channeled with the Partner Hotel.
- Rates: The rates shown in the first step of the purchase process are net, they do not include the IGV charge or service charge. In the last step of the purchase process only the service charge is added, if applicable, but the IGV, if applicable, will always be paid at the hotel reception. Rates are expressed per night/room, not per passenger. The cost of additional beds in the room depends on the availability of space in the room and beds in the hotel, so you should communicate directly with the Partner Hotel.
- The company name on the invoice or sales slip will depend on the Partner Hotel chosen by the Client.
- When booking an accommodation through this website, Apart Hotel San Martin is responsible for the Platform and consequently for the General Terms and Conditions set forth in this document, but not for the accommodation service provided by the Partner Hotel and the Customer Service policies regulated by the latter on its website.

- In case the credit card shows the messages: “denied”, “stolen”, “insufficient funds”, “expired date”, the reservation will be cancelled without prior notice.
- We reserve the right to cancel or modify reservations in those cases where it is considered that the customer has engaged in fraudulent or inappropriate activity.

- In the event of a situation – force majeure or fortuitous event – in which the Partner Hotel is not able to provide accommodation for the client, it undertakes to provide a solution by offering accommodation in any of its nearest hotels, or in other nearby hotels of similar or higher category.

Unwelcome Customer or Visitor Procedure
In Apart Hotel San Martin we care about providing a safe and respectful environment among our employees, guests, customers and community. For this reason, we have established an internal process that details the reasons for Apart Hotel San Martin to declare a client or visitor as NOT GRATIOUS.
Reasons for determining a customer or visitor NOT GRATEFUL:
- Leaving the hotel without checking out, leaving consumption or other outstanding debts to be paid.
- Check in to the hotel with false information or impersonating another person.
- Repeatedly attempting to pay with counterfeit money or with false documentation such as ID card, passport, false credit or debit card.
- Committing physical or verbal aggression, harassment, bullying or threatening a guest, collaborator, supplier or visitor as long as the aggressor’s responsibility is proven.
- Committing theft or robbery, in any of its modalities, during your stay or visit to the hotel (including those committed against suppliers, visitors, etc.).
- Entering the hotel with a minor and not registering him/her at the reception desk (in case you are not the minor’s parents, you must have a notarized letter or document proving that you are the minor’s guardian).
- To enter the hotel rooms with unidentified companions, with National Identity Card, Alien Registration Card or other official identity document issued by a competent national or foreign authority that reliably certifies such information (after validation by the hotel).
- Not responsible for damages to the hotel facilities (prior validation of the client’s responsibility).
- In case the client or visitor has weapons and does not present or refuses to show his “license to carry weapons”.
- For abandonment of goods with a value of US$1,000 or more.
- Incurring in fraudulent acts by means of which a benefit is sought by deceiving hotel personnel, prior validation of the client’s responsibility.
- Other dangerous, harmful, high-risk behaviors or behaviors that contravene the welfare, moral order and good customs of customers, visitors, suppliers and/or collaborators. These reasons will be evaluated by Customer Experience.
Consequences of declaring a customer or visitor NOT GRAT GRATEFUL
- Any client or visitor declared NOT GRATEFUL will be previously notified via notarized letter about the decision taken by Apart Hotel San Martin and the reason for such decision.
- Unwelcome guests or visitors will not be allowed to make reservations or stay again at Apart Hotel San Martin hotels.
In case a client or visitor declared unwelcome enters any of the Apart Hotel San Martin hotels, the hotel staff will activate the security protocol and invite the visitor to leave the hotel. If the client or visitor refuses to leave the hotel premises, security personnel and the Peruvian National Police will be called.
